Industrial and Intellectual Property

Panama has a comprehensive legal framework to protect Industrial and Intellectual Property rights.  

The General Directorate of the Industrial Property Registry (DIGERPI), attached to the Ministry of Commerce and Industries, is in charge of the registration process of Industrial Rights: Trademarks, Patents, Designs and Plant Varieties.

The National Directorate of Copyright, attached to the Ministry of Culture is in charge of the Copyright registration process in Panama: literary and artistic works, software, databases and other original creations.

Our legislation contemplates judicial proceedings for Intellectual Property, in the civil and criminal field. Panama has a special Intellectual Property jurisdiction, made up of Courts of Justice and Prosecutor’s Offices specialized in this matter. Our team of lawyers has expert litigators who successfully argue judicial proceedings before the circuit courts, superior courts and the Supreme Court of Justice.

Opposition, Cancellation and Nullity proceedings, as well as the civil infringement of Industrial and Intellectual Property Rights are handled before the civil sphere.

In the Criminal field, crimes related to the unauthorized use of Industrial and Intellectual Property Rights are investigated and prosecuted.
